One of them is the advertising law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Last 2018, the Ministry of Industry and Information Technology (MIIT) created an action against unsolicited telemarketing calls. China&#8217;s telemarketing laws state that:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Consent of users shall be obtained;<\/li><li>A white list of users shall be made;<\/li><li>Relevant materials shall be retained; and<\/li><li>The time and conduct of calls shall be regulated<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The most important factor to take into account is the user&#8217;s consent. The Administrative Provisions on Short Message Services (SMS) states that companies are prohibited from sending commercial communications to consumers without their permission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Consumer Rights Protection law, companies who wouldn\u2019t comply with their consumer\u2019s personal data rights will be required to make corrections or forfeit related illegal income.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They will also be given a warning or charged a fine of up to 10 times the illegal income. However, the Decision only regulates digital mediums, which makes its scope relatively narrow.&nbsp;&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">3. <a href=\"http:\/\/hk.lexiscn.com\/law\/administrative-provisions-on-short-message-services.html\" target=\"_blank\" rel=\"noreferrer noopener\">Administrative Provisions on Short Message Services<\/a><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">To standardize short message services, safeguard the rights and interests of users, and promote the development of the short message service market, the government established the Administrative Provisions on Short Message Services.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is following the Decision of the Standing Committee of the National People&#8217;s Congress on Strengthening Network Information Protection in China.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These laws govern the telemarketing and text message landscape in China.
